ADC,(Revenue) and others (Civil)- The provesion of Notification no.120.Mise dated 28-06-1923 of the Government of Bengal issued under section 7(2) of the Registration Act,1908 amalgamating all sub-Register in charge Sadar Office with the office of the registrar and authorizing such sb- Register to exercise and perform all the powers and duties to the registerer including the powers under section 30 of the Registration Act to receive and register document regard to the location of the property except the powers under sections 68 and 72 of the registration Act and that virtue of the said Notification the Sadar sub-register,Dhaka has authority and jurisdiction to receive and register the plaintiff petitioners documents of purchase  of the suit land.

The settele principle of law is that plaintiff must prove his own case.he can not rely on the weakness of the defence.The mandatory requirement of law is that a deed of sale of immovale property of value of Taka 100 or avobe must be registered as envisaged under section 54 of the transfer of property Act read with section 17(1)(b) and 49(a) of the registration Act.In order to comlete the transaction the transfer must be follwed by delivery of possession,physical or constructive,otherwisw the doccument shall remain a paper transaction without any legal effect.In case of monthly tenant the vendor must give notice to the tenent in possession of the transfer and induction of the transferee as the landlord with direction to pay him the rent
